.XXX Domain Name opt-out program

The adult industry has been a substantial part of the Internet since its inception. However, as the domain name system has expanded, it has become increasingly difficult to identify what individual websites offer without actually visiting them. Despite a sizable online market for adult entertainment, large sections of society do not wish to come into contact with its products. .XXX domain names are being introduced into the market as a means to provide both willing consumers of adult entertainment and those who wish to avoid it with an easily identifiable mark – the end of the web address. .XXX domains will be available to the general public starting in December 2011.

Not everyone wants to have their name associated with an .XXX domain. Given the importance of trade-marks to your company, there are steps that you can take now to prevent others from registering your trade-marks in connection with the name of an adult entertainment website. For the next 7 days, owners of registered trade-marks that were registered by September 1, 2011 can apply for a special block to prevent the registration of the corresponding .XXX domain. Please note however, that any names that have been blocked cannot be unblocked and converted into resolving names without being made available to the general public.

Names blocked during this period will not result in the registration of a conventional, resolving domain name at the .XXX registry. Instead, these names will be reserved and blocked from live use. For example, as a trademark holder of the term Pacific Online, we could apply to block the registration by anyone else of pacificonline.xxx. This is different than applying for the domain pacificonline.xxx and allows trademark and other rights holders to prevent registration of .XXX domains without registering the domain.
